What is haram in Islam?

Haram (حَرَام) is an Islamic term. By this is meant forbidden work.

Islam has declared various things as haram for the welfare of people and society. The welfare of the people is embedded in everything declared haram.

At the same time, it has strictly forbidden the Muslim nation to refrain from haram acts.

For those who abstain from the forbidden, there is a reward in the Hereafter. And for those who are forbidden, there is punishment.

Anything is proved to be haram through the clear narration of the Holy Qur’an and Hadith. In some cases, it has been proved haram is based on the research verdicts of the Imams.

There are some categories of haram. There is some haram which is considered a very serious and great sin.

Such as – adultery, drinking alcohol, killing people, etc. Islamic law provides for severe punishment for anyone who engages in this type of haram.

Again, there is some haram that is considered as a sin only. There is no provision of punishment in Sharia law for him.

But in the Hereafter Allah Ta’ala has the authority to punish for it. For example – looking at the bride. Calling someone sarcastic, etc.

However, if a person commits haram acts out of helplessness, it is not considered a sin. It is forgivable.

Haram things in marriage?

It is haram to imagine the image of another woman while having intercourse with one’s wife.

That is to say, even if he has intercourse with his wife, to keep the appearance of another woman present in his faith and mind as if he is having intercourse with that woman.

In the same way, when having intercourse with one’s husband, keep another man present in the imagination and faith as if one is having intercourse with that man. It is forbidden.

Many scholars of the four schools of thought have said that it is haram to imagine such a thing.

Some have called such acts adultery. According to some, it is Makrooh to do so. Again many have called it legitimate.

Forbidden thoughts and opinions of Imams

Ibn Haj al-Maliki said:

‘In the workplace, one must restrain oneself and others through words from this evil practice which is widely prevalent in society.

That is, when a man is attracted to a woman after seeing her, he is having intercourse with her.

He puts the woman he saw in front of his eyes. It is a kind of adultery. ‘(Al-Madkhal 2/195)

Ibn Muflih al-Hambali said:

Mentioned in Ibn Aqeel and Riyaatul Kubra and took a firm stand on the matter –

That is, if a man imagines the appearance of another woman during intercourse with his wife, he will be guilty. ‘(Al-Adab – 96)

Ibn Abidin Shami said –

‘I don’t see any of us objecting to the masala. Rather, Durar says,

When water or any other lawful thing is drunk in the form of a joke or intoxication, it becomes haram.

And the rule of our madhhab is not to be halal.

Because imagining that woman in front of him and having sex with her directly means sinning.

It became like the masala of drinking. ‘(Hashiyat Ibn Abidin 6/372)

However, some scholars of the Shafi’i school of thought said that it was haram, but they agreed that it was valid.

The book of the Shafi’i school is called Tuhfatul Muhtaj Sharhul Minhaj –

‘He who has intercourse with his wife imagines the beauty of a woman and even feels as if he is having intercourse with that woman.

So is this imagination and feeling haram? Mutayakhkhirin Jamaat has disagreed on this issue.

However, they all acknowledged that this issue has not been discussed in the past.

Then a group of Muhaqqiq, such as Ibn Firqan, Ibn Biyari, Raddad Sharihul Irshad, and many others, including Suyuti, said that it is valid.

Taki As Subki’s discussion on the principle of ‘Sadduz Yarayi’ also demands this.

The first part is narrated from the Prophet (peace and blessings of Allah be upon him) as a document in this month.

‘Allah has forgiven whatever arises in the heart of my Ummah.’ Presents the hadith. ’(Tuhfatul Muhtaj Sharhul Minhaj – 6/205)

Those who have given the opinion that it is haram in the masala have presented only one or two arguments and the statements of the scholars of the madhhab as evidence.

On the other hand, those who say it is valid to have also submitted documents that are not documented on the subject under discussion.

Evidence of not being haram

Considering both aspects, it is seen that we do not have any strong document to say that the matter mentioned in the question is Haram.

Especially according to the Hanafi school. Because to declare something haraam according to the principles of the Hanafi school, irrefutable and clear documents are required.

But there is no such document here. Again, it cannot be said to be valid.

Because every conscientious person will look at this matter with evil and condemnatory eyes.

This is one of the reasons why the majority of the scholars of the Ummah say that it is haram.

There is a Marfa hadith narrated from Ibn Masood (may Allah be pleased with him) –

‘What Muslims think is good is good for Allah. And what Muslims think is evil is evil in the sight of God. (Mustadrak Alas Sahihain – 4465, Sahih)

Therefore, this act is considered evil by Muslims, so it must be called an evil act.

Jabir – Radiyallahu Anhu – Narrated –

‘The Prophet (peace and blessings of Allah be upon him) saw a woman and when his wife came to Zaynab, he (Zaynab) was shaking one of her skins.

Then he fulfilled his need and came to the Companions and said that women come in the guise of Satan,

Again goes to the devil’s tune, so if any of you see a woman he should be reunited with his wife.

Because it will take away whatever is in his mind. ‘(Sahih Muslim – 3473)

This hadith also proves that what is born in the heart after seeing a woman is a sinful act to keep alive in the mind.

Because in the mentioned hadith, the Prophet (peace and blessings of Allah be upon him) taught the way to remove what is born in the heart after seeing a woman.

Evidence of the topic discussed

Since the hadith proves that it is wrong to keep the attraction of different women alive in the heart.

And while having the opportunity to imagine the image of another woman during intercourse with one’s wife, one is being allowed to do so.

Therefore, validity cannot be ordered in the month in question. Rather, such work should be called illegal.

But this is no stage of invalidity. Is it haram or Makrooh? If it is Makruh, then Tahrimi or Tanzihi. Since there is no strong document to say Haram.

So it would be appropriate to say Makruh. As Ibn Biyari says – ‘The matter should be Makrooh.’ (Tuhfatul Muhtaj – 6/205)

And it would be fair to say that it is Makrooh Tahririm considering all the side effects of the issue, Dalail, Shariah rules, and the importance of the opinion of the scholars.
